1. Definitions

  • Commercial Electronic Message (CEM)
Any electronically transmitted message, including by email, that encourages participation in a commercial activity—including emails promoting green energy products, services, reviews, or affiliate links.
  • Consent
Express Opt-In Consent: A contact must clearly affirm (e.g., via ticking an unchecked box or replying “yes”) their agreement to receive CEMs from us. Pre-checked boxes, silence, or inactivity do not constitute consent.
  • Unsubscribe Request
A recipient’s request—via any reasonable means (e.g., clicking an “unsubscribe” link or emailing us)—to stop receiving further CEMs.

2. Express Opt-In Requirement

  • We will not send any CEMs unless the recipient has provided express opt-in consent.
  • At opt-in, we must clearly state:
    • Who is sending the messages (our identity)
    • What content they will receive
    • That they may withdraw consent at any time via a simple method.

3. Unsubscribe Process & Perpetual Suppression

  • Every CEM must include a functional, clearly labeled unsubscribe mechanism (e.g., “Unsubscribe” link or reply-to).
  • We will honor unsubscribe requests within 5 business days.
  • Once someone unsubscribes, their email address is placed in a perpetual suppression list—we must never send CEMs to them again (unless they explicitly re-opt-in).

4. Message Format Requirements

  • Headers: Must be clear, accurate, and identifying.
  • “From” line: Must accurately reflect who is sending the message (e.g., “Green Energy Reviews via energycourses.online”).
  • “Subject” line: Must not be deceptive—accurately reflect the content of the email.

5. Prohibition of Misleading Routing

  • No deceptive techniques: URLs, domain names, IP addresses, headers, or routing must not mislead recipients about origin, sender, or content.

6. Record-Keeping & Audit Trails

We’ll maintain, for at least 4 years:

  1. Opt-in records: what was consented to, when, how, and by what means (e.g., web form, date, IP address).
  2. Unsubscribe records: timestamps, request method (link, email), and confirmation.
  3. A perpetual suppression list.
  4. Audit logs: to evidence compliance, accessible for legal or regulatory review.

7. Third-Party Mailings & Liability

  • If we engage third-party partners or affiliates to send CEMs on our behalf, those third parties must comply with this policy.
  • We disclaim liability for third-party non-compliance—but such entities must indemnify and hold us harmless if any violations occur.

8. Severability

If any part of this policy is deemed invalid or unenforceable under applicable law, that portion may be severed without affecting the remainder, which remains in full force and effect.

9. Choice of Law & Jurisdiction

This policy is governed by the laws of Latvia, and any disputes shall fall under the exclusive jurisdiction of the courts in Riga, Latvia.
